PREFACE
The
National Historic Preservation Act (NHPA) established the National Register of
Historic Places, and it is the basis of the State Historic Preservation
Office's programs. Oklahoma's National Register Handbook includes a
county by county listing of Oklahoma's National Register listings, the National
Register Criteria for Evaluation, and other helpful information. For a listing
of properties added to the National Register since publication of the handbook,
users can request a supplemental listing from the State Historic Preservation
Office.
The
State Historic Preservation Office, Oklahoma Historical Society, invites
concerned citizens, nonprofit organizations, and government entities to help us
extend the benefits of National Register listing to properties that represent
the development of Oklahoma and the accomplishments of all of its people. Tomorrow's
Legacy: Oklahoma's Statewide Preservation Plan sets forth the goals and
objectives of the State's preservation community and suggests how everyone can
participate in the identification of properties for National Register listing,
as well as in efforts to protect them. We all share the responsibility for this
important work, and together we can succeed. Copies of the State Plan are
available from the State Historic Preservation Office.
THE
NATIONAL REGISTER OF HISTORIC PLACES
The
National Register of Historic Places is a catalog of American culture -- the
tangible elements of our archaeology, our history, and our architecture. The
register records the sites, buildings, districts, structures and objects which,
through their often imposing presence, keep us in touch with the achievements
of our past.
It
is essentially a continuing inventory which identifies both sites and the
material remains of these cultural developments that have molded our nation
from its prehistory to its present.
But
the register goes beyond mere listing. It provides an authoritative guide to
help federal, state and local governments, private groups and citizens to
recognize the nation's cultural resources, enabling these groups to protect and
sustain our heritage in the process of planning for the future.
The
National Register of Historic Places is only one facet of a comprehensive
national program established by the National Historic Preservation Act.
The
NHPA set up a matching grants-in-aid program that sponsors state-based historic
sites surveying and master planning, and encourages restoration of listed
properties by state and local groups and individuals. The NHPA also set up an
Advisory Council on Historic Preservation whose members advise the President and
Congress on preservation matters. The Council is empowered to review any case
where federally funded or federally licensed projects might threaten National
Register properties.
CRITERIA
FOR EVALUATION
The
following criteria have been established to guide the states and the U.S.
Secretary of the Interior in evaluating potential entries to the National
Register.
The
quality of significance in American history, architecture, archaeology and
culture is present in districts, sites, buildings, structures and objects that
possess integrity of location, design, setting, materials, workmanship, feeling
and association, and:
*
that are associated with events that have made a significant contribution to
the broad patterns of our past; or
*
that are associated with the lives of persons significant in our past; or
*
that embody the distinctive characteristics of a type, period or method of
construction or that represent the work of a master, or that possess high
artistic values, or that represent a significant and distinguished entity whose
components may lack individual distinction; or
*
that have yielded, or may be likely to yield information important in
prehistory or history.
Certain
properties are not ordinarily considered eligible for inclusion in the National
Register. These include cemeteries, birthplaces or graves of historical
figures, properties owned by religious institutions or used for religious
purposes, structures that have been moved from their original locations,
reconstructed historic buildings, properties primarily commemorative in nature,
and properties that have achieved significance within the past 50 years.
Such
properties are given consideration if they are integral parts of districts that
do meet the criteria or if they fall within the following categories:
*
a religious property deriving primary significance from architectural or
artistic distinction or historical importance; or
*
a building or structure removed from its original location but which is
significant primarily for architectural value, or which is the surviving
structure most importantly associated with a historic person or event; or
*
a birthplace or grave of a historical figure of outstanding importance if there
is no appropriate site or building directly associated with his/her productive
life; or
*
a cemetery which derives its primary significance from graves of persons of
transcendent importance, from age, from distinctive design features or from
association with historic events; or
*
a reconstructed building when accurately executed in a suitable environment and
presented in a dignified manner as a part of a restoration master plan, and
when no other building or structure with the same association has survived; or
*
a property primarily commemorative in intent if design, age, tradition or
symbolic value has invested it with its own historical significance; or
*
a property achieving significance within the past fifty (50) years if it is of
exceptional importance.
TYPES OF
NATIONAL REGISTER PROPERTIES
Properties
may be nominated to the register in one of five categories: district, site,
building, structure, and object.
A
district is a geographically definable area, urban or rural with a significant
concentration, linkage or continuity of sites, buildings, structures or objects
which are related historically or aesthetically.
A
site is the location of a significant event, activity, building, structure or
archaeological resource where the significance of the location and any
archaeological remains outweighs the significance of any existing structures.
A
building is a structure such as a house, barn, church or hotel created to
shelter any form of human activity; the term "buildings" may refer to
a historically related complex such as a courthouse and jail or a house and
barn.
A
structure is a man-made construction of interdependent and interrelated parts,
organized in a definite pattern. It is often a large-scale engineering project.
An
object is a material thing of functional aesthetic, cultural, historical or
scientific value; it may be movable by nature of design, yet related to a
specific setting or environment.
WHAT THE
NATIONAL REGISTER DOES
1.
Provides recognition of a property's significance in history, architecture,
archaeology, or engineering.
2.
Provides limited protection when a property is endangered by a federally funded
or federally licensed action.
3.
Provides the owner of an income-producing property (commercial or rental
residential) the opportunity to receive investment tax credits for
"certified rehabilitation."
4.
Provides the owner the opportunity to apply for matching grants-in-aid for
restoration/rehabilitation (when funding is available).
WHAT THE
NATIONAL REGISTER DOES NOT DO
1.
Does not restrict the use of the property. (For example, an owner can continue
to live in a listed house, convert a listed property to another use, continue
to farm ground where a listed archaeological site may be located, conduct new
construction on the site, etc.)
2.
Does not restrict the sale of private property.
3.
Does not require continued maintenance of private property.
4.
Does not require that any specific guidelines be followed in rehabilitation
(unless the owner is using federal funds or receiving an investment tax
credit).
5.
Does not require the owner to give tours of the property or open it to the
public.
6.
Does not guarantee funds for restoration.
7.
Does not guarantee perpetual maintenance of the property.
8.
Does not provide a tax credit for a private residential structure.
9.
Does not provide a historic marker for the property.
THE
NATIONAL REGISTER NOMINATION PROCESS
1.
Any person or organization can submit a nomination for any property.
2.
To nominate a property to the National Register, a "National Register of
Historic Places Registration Form" and, if appropriate, a "National
Register of Historic Places Multiple Property Documentation Form" must be
completed and submitted to the State Historic Preservation Office.
3.
The State Historic Preservation Office staff reviews each nomination received.
If the nomination is complete and in acceptable format, it will be scheduled
for presentation at the earliest possible Historic Preservation Review
Committee meeting. Unacceptable nominations will be returned to the preparer
with written comments.
4.
The Historic Preservation Review Committee meets at 10:00 a.m. on the third
Thursday of January, April, July, and October in the Oklahoma Historical
Society Boardroom, unless otherwise announced.
5.
If the Historic Preservation Review Committee approves the nomination, it will be
sent to the Keeper of the Register, Washington, D.C. Written comments received
before or during the Committee meeting will be transmitted with the nomination
to the Keeper of the Register.
6.
The Keeper of the Register has forty-five (45) days from the date of their
receipt of the nomination to act. The Keeper can list the property in the
National Register, issue a determination of eligibility (in special
circumstances), reject the property for listing, or return the nomination for
additional information or clarification.
7.
The Keeper notifies the State Historic Preservation Office of the listing of
the property in the National Register of Historic Places, and the SHPO then
notifies all property owners and elected state and local officials of the
designation. The SHPO shall also inform the owner (and nomination preparer, if
not the owner) when a property is rejected for listing or returned for
additional information.
8.
If an owner requests it in writing, a certificate denoting listing in the
National Register will be issued by the SHPO.
NOTE:
If a property proposed for nomination to the National Register is located
within the jurisdiction of a Certified Local Government (CLG), the local
historic preservation review commission will review and comment on the
nomination prior to the SHPO's scheduling it for the Historic Preservation
Review Committee's consideration. Current information about which Oklahoma
cities and towns participate in the CLG Program is available from the SHPO.
HOW
NOMINATIONS ARE SCHEDULED FOR THE REVIEW COMMITTEE
Acceptable
nominations received by the State Historic Preservation Office are scheduled
for the first possible meeting of the Historic Preservation Review Committee.
Generally, acceptable nominations received sixty (60) days prior to a meeting
of the Committee will be presented. However, if more nominations are received
than can be processed in accordance with federal regulations, the nominations
will be scheduled in accordance with the priorities listed below:
1.
Properties considered to be endangered;
2.
Properties that are examples of a rare type or that are surviving examples of a
once common type;
3.
Properties that are candidates for special tax incentives or grants programs;
4.
Properties considered eligible for nomination to the National Register by a
Certified Local Government;
5.
Properties for which there is a demonstrated public concern; and
6.
Other properties for which sufficient documentation exists to warrant
nomination to the National Register of Historic Places.
WHO IS
THE SHPO?
In
Oklahoma, the Governor appoints the Oklahoma Historical Society's Executive
Director as the State Historic Preservation Officer (SHPO). The SHPO is responsible
for administration of the National Register programs in the state. Among these
duties are survey and inventory of Oklahoma's historic and prehistoric
resources, nomination of eligible properties to the National Register of
Historic Places, review of federally assisted or federally licensed
undertakings, review of proposed rehabilitation projects under current federal
tax laws, development of a comprehensive historic preservation plan, conduct of
the Certified Local Governments (CLG) Program, and provision of technical
assistance to other government agencies, preservation organizations, and the
general public.
WHAT IS
THE HISTORIC PRESERVATION REVIEW COMMITTEE?
A
state review board composed of professionals in the fields of history,
architecture, archaeology, and architectural history, as well as citizen
members, provides advice to the SHPO in each state. Oklahoma's review board is
the Historic Preservation Review Committee. The membership is appointed by the
Governor. The Committee has as its primary responsibility the review of all
National Register nominations the SHPO submits to the Keeper of the Register.
HOW
ARE PROPERTY OWNERS & THE PUBLIC NOTIFIED ABOUT PROPOSED NATIONAL REGISTER
NOMINATIONS?
When
the SHPO staff determines that a National Register nomination under review
in its office is complete and in acceptable form, it is scheduled for the next
possible Historic Preservation Review Committee meeting. In accordance
with National Park Service (NPS) regulations (36 CFR Part 60), the SHPO notifies
the owners of the property and the appropriate chief elected local official
(with courtesy copies provided to the appropriate State Senator and
Representative) of the pending nomination. If there are fewer than fifty
(50) property owners involved, the SHPO sends NPS approved notification by
certified mail to each owner and to the chief elected local official. If
a property involves fifty (50) or more property owners, the SHPO publishes a
general notice in a newspaper of general circulation in the area where the
property is located (historic districts are the most common properties to
involve 50 or more owners), and a notice is sent by certified mail to the chief
elected local official. Whichever notification process is used, the
notice is given not less than thirty (30) nor more than seventy-five (75) days
in advance of the Historic Preservation Review Committee meeting at which the
nomination will be considered. The notice stipulates the property that is the
subject of the nomination; explains the meaning of the National Register
listing; informs the recipient about the date, time and place of the
Committee’s meeting; provides the date, time and place of an informational
meeting in the local community when the property proposed for nomination is a district;
and explains how owners may object to the nomination (see CAN A PROPERTY OWNER OBJECT TO LISTING
OF HIS/HER PROPERTY IN THE NATIONAL REGISTER? IF SO, HOW?
below). In the case of historic district nominations, the SHPO also issues
a press release to the local newspaper and other media and provides an article
for publications such as neighborhood newsletters. Complete copies of the
proposed nomination are made available upon request from the SHPO and at the
informational meetings held for historic district nominations.
HOW
CAN PROPERTY OWNERS & OTHERS EXPRESS SUPPORT OF A NATIONAL REGISTER
NOMINATION?
Any property
owner, local official, or citizen may express support for a National Register
nomination under consideration by the SHPO, and all such written statements
that the SHPO receives will be transmitted to the NPS. These statements
may be forwarded to the SHPO by regular mail, fax, or e-mail or hand delivered
to the SHPO at the address on the front cover of this publication, or at the
Historic Preservation Review Committee meeting when the nomination is
considered.
CAN AN OWNER
OBJECT TO LISTING OF HIS/HER PROPERTY IN THE NATIONAL REGISTER? IF SO,
HOW?
Yes. Property
owners have the right to object to the listing of their property in the
National Register. If a simple majority of the private owners provide a
notarized statement to the State Historic Preservation Officer (SHPO) that they
are the sole or partial owner of a specific property and that they object to
the listing of the property in the National Register, it will not be
listed. When a majority of the property owners file such objections with
the SHPO (by regular mail or in person) at the address shown at the
beginning of this document by the deadline specified in the notice to property
owners about the nomination, the SHPO will complete the formal review of the
nomination under the NPS regulations (36 CFR Part 60). However, the Keeper
of the Register will issue a Determination of Eligibility rather than formally
list the property.
While public
property owners, such as city and county governments, may not support
nomination of their property to the National Register, their objections do not
prevent formal listing in the National Register.
Property owners
should feel free to contact the SHPO about their questions concerning the
National Register and their rights. Or, they may visit the NPS website
(www.cr.nps.gov/nr/) for additional information. For the convenience of
owners who wish to object to a National Register nomination, the SHPO will
provide a form objection letter upon request. Anyone has the right to petition
the Keeper of the Register directly about objections to a nomination.
REMOVING
PROPERTIES FROM THE NATIONAL REGISTER
Properties
nominated by state or federal agencies will be removed from the National
Register only when they have ceased to meet the criteria for the National
Register, or when the qualities which caused them originally to be nominated
have been lost or destroyed, or upon proof that an error in professional
judgment has been made, or for failure to follow the procedures set forth by
the Department of the Interior. Information concerning the loss of integrity,
error in judgment or procedural error should be submitted, through the
appropriate State Historic Preservation Officer or federal representative, to
the Keeper of the Register, Washington, D.C.

the city (or vicinity) name, each entry includes: property name (followed in

nomination, if any of these designations are applicable); location (unless this

effort to eliminate the prohibited practices.

Should these efforts fail, federal assistance may be terminated or discontinued

Other means authorized by law, including court action, may also be used to
enforce nondiscrimination.
No
recipient or other person may intimidate, threaten, coerce or discriminate
against any individual because he or she has made a complaint, testified or
assisted in a Title VI investigation, proceeding or hearing.
ASSURANCE
The
Oklahoma State Historic Preservation Office complies with Title VI of the Civil
Rights Act of 1964 (P.L. 88-352) and all regulations imposed by or pursuant to
the Department of the Interior Regulation (43 CFR 17) issued pursuant to that
title, to the end that in accordance with Title VI of that Act and the
Regulation, no person shall, on the grounds of race, color, or national origin
be excluded from participation in, be denied the benefit of, or be otherwise
subjected to discrimination under any program or activity for which financial
assistance from the Department of the Interior has been received.
Any
person who believes that he or she has not received fair and equitable
treatment with regard to participation in the programs of the Oklahoma State
Historic Preservation Office should submit a written statement to that effect
